Ban appeal

EDIT: I have no intention for other players to be punished. If anyone will be punished for what happened, I will immediately delete the appeal.

FULL RP Name(s): HECU SILVERHAND LCPL Shogun, LVET SILVERHAND PVT Shogun, EOW RIFLEMAN 09 0721, OTA SWORD 09 0721 (during the tryout, the name changed often, but at the time of the ban it was EOW COCKGARGLER 09 0721)

Discord Username: Minishogun721#4983

Who warned/banned you?: mint julep

Date of Warn/Ban: Sunday, February 13, 2022

Ban Length: 12 weeks, ends on May 8, 2022

Warn/Ban Reason: MRDM

Why should we remove the warning/ban?
The ban should be removed because of the uneven enforcement of rules, my understanding of the situation, and my prior track record.

I feel as if I should try to establish a coherent timeline of events before getting into the main part. HECU tryouts tend to be strange, for lack of a better term. Mass TKing, joke questions, and other nonsense usually ensues. Such happened. Fast forwarding to the main incident, a group of people had gathered around the DB area on C13, where Mint was logging the new recruits. He said to “clear the peaceful protest.” I’m sure you can guess what happened next. Myself and Dopplah were banned for MRDM. As far as I know we were the only ones punished for what happened.

I believe that there was uneven enforcement of rules. Not between myself and Dopplah, but in general. Before the tryout, I was shot by a fellow technician. Not a problem. I died multiple times to teammates. Not a problem. Of course the combat portion of the tryout is a nonissue, it’s what happens. What I am saying is that I had to have personally killed at least 7 teammates before the “incident.” My fellow rebels also teamkilled. No action taken.

My understanding of the situation genuinely had me believe that what I was doing was considered a part of the tryout and the shenanigans that surround it. As I’ve said before, HECU tryouts are a mess. A romp of playermodel switching, colors, racist jokes, teamkilling, etc. When mint says to “clear a peaceful protest” in the most ominous way possible, there’s nothing else in my mind other than “open fire.”  CVR. Even then, how else would we clear it? We’re not MPs. We don't have a physgun. Either way, we were in a public zone so that interpretation is totally invalid. Cheeto said to stop. I stopped, no more anything after that other than a ban.

Finally, and what I believe is my best point, is my prior track record. While it may seem counterintuitive as I have MRDM’d before, the circumstances are totally different. The prior incident was a result of me going into that situation knowing what was going to happen. I equipped Martyr, walked in, and hit kill bind. I was burnt out, and school was beginning to pile on. Same offense, totally different reasons and circumstances. It’s why I didn’t make a ban appeal. Besides the prior MRDM and even further back ERP incident, I believe my only warning on CVR was the first day, where I said the n-word hard r in OOC. Other than that, my official track record is literally spotless. I don’t think I was ever even in a sit from the first MRDM ban to this current, second one. This isn’t a “please forgive me,” it’s logic: why would I give up a near-perfect track record, enrollment in divisions I’ve always wanted to be in, and precious time and effort on a whim? Last time, I knew what I was doing. I CK’d my REAPER and RECON, and got ready to attend the last MD for a very long time. I know what happens when someone MRDMs, so why would I give up everything I had unless I had prior knowledge?

Lastly, the big one: “it’s still MRDM.” I’m almost certain that me and Dopplah weren’t the only ones at that area that opened fire. I’d like to know what happened to those people. I’d also like to know why there wasn’t any punishment given afterwards. I’d also like to know how a nonissue before turns into an issue after. With enforcement of RDM rules, either all of it's okay or none of it is. If staff choose to side with the latter statement, it's very strange how me and Dopplah were the only ones where action was taken.

Evidence/Other: Cheeto has posted a link to a video of the incident, ill link it here https://m.youtube.com/watch?v=EBl51LmEQ5...nel=cheeto

This doesn't seem like an appeal to your ban, this just seems like you want other people to get punished the same way you did.

I have no desire for anyone to be punished, and I tried my best to make sure it didn't come off that way. My first sentence states my intentions, and the entire paragraph about track record has nothing to do with others. I'm saying because me and Dopplah were the ONLY ones punished, that the ban should be lifted or reduced.

Hate to say it but nothing happens when you've been RDM'd unless you report it
You must've gotten reported by someone, hence why action was taken

If it was reported by a player it should've been taken to a sit, not dealt with then and there. The only other thing I can think of is if a higher-up staff member forced mint to take action, or if he did it on his own accord.

The whole "RDMed as a joke man, its tryouts, its debrief joke lol its joke man" is retarded and is ruining the server by making newer players think they can just go around and RDM people as a joke. Its clearly stated in the rules that RDM is not allowed and is punishable.

If every DB and tryout RDM was evenly enforced that day, there would be a ban list as long as this appeal and some staff demoted. If it was enforced every day, then there'd be a very, very large ban list until people readjust.

Never in my entire time playing CVR have I been angry about being RDMed, maybe angry if TKed during intense combat. I seriously doubt RDM is a "ruining the server" issue.

It doesn't matter to this appeal if you see other people RDM and go unpunished, what matters is that *you* broke the rules.

If you also want to start reporting other people for RDM go for it, but individual staff members' negligence on other occasions is not an excuse for you to be unbanned.

Getting too far into the "purpose of RDM" in this appeal, it's still against the rules.

It's not just that. It's that I genuinely thought nothing would come of it, as in the past nothing had come of it before. Consider the track record too, if I knew that this would be enforced as harshly, it at all, as it was there's no way in Hell I'd still do it.

I don't care about the actions of others, just the uneven effects of the consequences. Do you really think I want some of my best friends on CVR, and other players just trying to enjoy the tryout to get booted for it or even lose their hard-earned staff status? No. What I want is to rejoin them because of not just the uneven consequences, but because of the circumstances and my past track record.

Either way, unfair or uneven are 2 of the only reasons to make a ban appeal. I personally believe both of those categories were met.
